Pope John Paul II Academy – Annual Gala Website Terms of Service

1) Acceptance of these Terms
By accessing or using the Pope John Paul II Academy Annual Gala website (the “Site”), purchasing tickets, making a donation, registering as an attendee, bidding, or submitting sponsorship information, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Site.
2) Purpose of the Site
The Site is provided to:
share information about the Annual Gala (the “Event”),
sell Event tickets and related items (e.g., tables, add-ons, raffle entries where permitted, auction items where applicable),
accept donations,
facilitate sponsorships, and
collect attendee details required for Event planning and fulfillment.
3) Eligibility
You represent that you are at least 18 years old (or the age of majority in your jurisdiction) or have permission of a parent/guardian to use the Site and complete any transactions.
4) Purchases, Donations, and Sponsorships
Ticket purchases: All ticket and table purchases are final unless a different refund policy is clearly stated on the Site or in your order confirmation.
Donations: Donations are generally nonrefundable. If you believe a donation was made in error, contact us promptly.
Sponsorships: Sponsorship benefits (recognition, reserved seating, advertising, signage, etc.) are subject to (a) availability, (b) deadlines for providing logos/materials, and (c) reasonable production/print constraints.
5) Payment Processing
Payments are typically processed by third-party providers (e.g., payment processors or ticketing platforms). The Academy does not store full payment card numbers. Your payment may be subject to the third party’s terms and privacy practices.
6) Event Changes, Cancellation, and Force Majeure
The Academy may modify Event details (date/time/location/program) when reasonably necessary. If the Event is cancelled or rescheduled, we will communicate any applicable refund/credit options on the Site and/or by email.
We are not responsible for delays or cancellation due to causes beyond our reasonable control, including severe weather, fire, venue issues, government orders, public health emergencies, utility failures, or acts of God.
7) Attendance, Conduct, and Safety
Attendees agree to behave respectfully and follow venue rules and staff instructions. We may refuse admission or remove individuals for disruptive, unsafe, or unlawful behavior without refund.
8) Dietary Needs and Accessibility
If you provide dietary or accessibility requests, we will make reasonable efforts to accommodate them, but cannot guarantee accommodation in all circumstances—especially if requests are submitted after any posted deadlines.
9) Silent Auction, Live Auction, and Raffles
If the Event includes auctions or raffles:
Bids are binding at close, as announced at the Event or posted on the Site.
Winners are responsible for prompt payment and any pickup/shipping arrangements.
Some items may have restrictions, blackout dates, or expiration dates.
Raffles are void where prohibited and may be subject to separate posted rules and eligibility requirements.
10) Photos, Audio, and Video Recording (Media Release)
By attending the Event and/or participating in Event activities, you grant Pope John Paul II Academy permission to capture and use photographs, audio, and video that may include you for lawful Academy purposes (e.g., marketing, fundraising, reporting, social media, and archival use) without compensation.
If you have a serious privacy or safety concern, contact us in advance at [email protected]. We will try to offer reasonable options, though we cannot guarantee exclusion from all incidental capture in public areas.
11) Intellectual Property
All content on the Site (text, logos, graphics, photos, videos) is owned by or licensed to the Academy and may not be copied, modified, distributed, or used without permission, except for personal, noncommercial use.
12) Prohibited Uses
You agree not to:
interfere with Site operation, security, or access,
submit false or misleading information,
attempt unauthorized access to systems or data,
use the Site to violate any law or third-party rights.
13) Disclaimers and Limitation of Liability
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, the Academy disclaims all warranties of any kind.
To the fullest extent permitted by law, the Academy will not be liable for indirect, incidental, consequential, special, or punitive damages arising out of your use of the Site or participation in the Event.

15) Governing Law and Venue
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Venue for disputes shall be in the state or federal courts serving Montrose County, Colorado, unless otherwise required by law.
16) Changes to These Terms
We may update these Terms from time to time. The “Effective date” will reflect the latest revision. Continued use of the Site after updates means you accept the revised Terms.
